ADMINISTRATIVE ORDER 2021-1 PRESCRIBING PROCEDURES FOR THE FILING, SERVICE, AND MANAGEMENT OF HIGHLY SENSITIVE DOCUMENTS
(Posted: 3/1/2021)

In response to the recent disclosures of widespread breaches of private sector and government computer systems, the Administrative Office of the United States Courts has directed federal courts to establish additional security procedures for the protection of certain highly sensitive documents. The AO's examples of highly sensitive documents include documents relating to applications for electronic surveillance under 18 U.S.C. Section § 2518, initial applications for search warrants, and intellectual property or trade secrets. Generally, the types of documents filed in bankruptcy cases, such as bank records, Social Security records, health records, settlement agreements, and valuation reports, do not meet the description of a highly sensitive document. When appropriate, those types of documents may be filed under seal under Local Rule 5005-4.
