MEANS TEST

One of the major changes brought about by the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (“Act”) was the implementation of a “means test” to be applied to chapter 7 & 13 cases for debtors whose incomes exceed the median income for their states.

As a follow up to the CLE program on the new legislation which took place in June of 2005, Judge Williamson has created an Excel spreadsheet which performs the means test calculations within Interim Official Form B22A (Chapter 7) and B22C (Chapter 13). The form uses the IRS tables applicable to the counties in the State of Florida. For use in other areas, it will be relatively simple to substitute the applicable tables for those areas.

Feedback on the form is welcome particularly in terms of errors in the formulas that drive the spreadsheet. Please direct comments to marym@flmb.uscourts.gov.

The cells in the spreadsheet are locked and protected to avoid inadvertent deletions. To unlock the cells in order to make modifications to the means test calculator spreadsheet, go to Tools, Protection, Unprotect Sheet and enter the password: means.
